In 2004, the claimant acquired the freehold of an area of open land. Until around 1980, the land had been used for grazing but had not been put to profitable use since. The land was crossed by two footpaths over which the public had a right of way, but local residents had for many years walked on the land without keeping to the footpaths. The land had been registered as a town or village green (TVG) in June 2001, on an application, under section 13 of the Commons Registration Act 1965, to the first defendant council as the registration authority. The registration had been made under section 22(1)(c) of the 1965 Act on the ground of 20 years’ recreational use of the land by local inhabitants as of right. After acquiring the land, the claimant brought proceedings to rectify the register and cancel the registration under section 14 of the 1965 Act.

Rulings on two preliminary points in the proceedings were upheld by the Court of Appeal: see [2008] EWCA Civ 22; [2009] 1 WLR 334. The High Court then proceeded to decide the substantive issues, namely whether the 2001 registration ought to have been made and whether it was just to rectify the register. The second defendant, a local resident, joined the proceedings by consent in support of the registration.
