Contractual right to acquire land lost in renegotiation

Whether a contractual right to acquire an interest in land survives a renegotiation depends on what the parties have agreed.

In determining the issue, the High Court has considered the provisions of agreements reached in 2004 and 2018 in University College London Hospitals Charity and another v The Mayor and Burgesses of the London Borough of Camden [2023] EWHC 1070 (KB).

The first claimant charity acquired from the University College London Hospitals NHS Trust redundant land from the UCLH estate following the opening of the new hospital in the early 2000s. This included the Middlesex Annexe Site (the MAS).
